  1. Restrictions on motorcycle passengers. -- Texas. House Bill 3838, also called Malorie's Law, "prohibit(s) the carrying of or riding by a passenger on any motorcycle that is not equipped with footrests and handholds for use by the passenger." According to some sources, many Texan motorcyclists were not aware of this at all!

But now, they're back on the road, and both bikers and motorists have a responsibility to keep each other safe, according to Ed Schetter, executive director of American Bikers Aimed Toward Education of Ohio. "Many people aren't used to seeing motorcyclists because they have been off the road since October or November," said Schetter, of Fostoria. "We do have a smaller profile than the automobile ... motorists just need to take a little extra time to look for us," he said. May is also Motorcycle Safety Awareness Month. Last year in Ohio, there were 152 fatal motorcycle crashes, including two in Hancock County, according to Lt. Jerrod Savidge, commander of the Findlay post of the State Highway Patrol. In northwestern Ohio, Wood County had two motorcycle fatalities, Seneca, Allen and Henry counties each had one, and Putnam, Hardin and Wyandot counties didn't have any last year, according to the patrol. "(Motorcycles) have just as much of a right to be out there as passenger cars or trucks. It just has to be a mutual respect for safety out there," said Hancock County Sheriff's Sgt. Mike Cortez. Schetter and Cortez said many motorcycle accidents occur because of right of way violations, like vehicles following too closely or failing to yield. "If you have a rear-end accident with an automobile, you are going to damage the car's bumper, but if you run into the rear of a motorcycle, you are going to knock out the bike from underneath the rider," Schetter said. This could lead to severe injuries or even death, he said. It's less risky for car drivers to slam on their brakes compared to a motorcyclist, Cortez said. "If they have to stop suddenly, likely they are going to lay their bike down and cause an accident," he said. Motorcyclists also have a duty to protect themselves and other drivers, Schetter said. "Make sure you are physically ready to ride and the bike equipment is ready to go," he said. Look out for potholes and rough railroad crossings and "be aware that automobile drivers aren't used to seeing us out on the road," he said. Savidge said motorists should anticipate motorcycles swerving around potholes or debris that a car or truck might go through. Allowing for extra space between vehicles will help, he said. NCOM BIKER NEWSBYTES Compiled & Edited by Bill Bish, National Coalition of Motorcyclists (NCOM) MULTI-FACETED MOTORCYCLE BILL ENACTED IN TEXAS Senate Bill 1967, authored by Texas State Senator John Carona (R-Dallas) and sponsored by Representative Norma ”Da’Lady” Chavez (D-El Paso), introduces many motorcycle-related changes in the Lone Star State. Included in the bill are 1) funding by Texas Department of Transportation for a public awareness campaign to promote motorcyclist safety and the concept of sharing the road with motorcyclists; 2) changes to the definition of a motorcycle to include certain enclosed three-wheeled passenger vehicles; 3) changes to the licensing requirements for enclosed three-wheeled passenger vehicles; 4) a requirement for all applicants for a motorcycle license or endorsement on a regular or commercial driver's license to provide proof of successful completion of a basic motorcycle operator training course; 5) penalties for failure to yield the right-of-way violations resulting in bodily injury range from $500 to $2,000 while those resulting in serious bodily injury range from $1,000 to $4,000; 6) a prohibition against stopping or detaining a motorcycle operator or passenger solely to determine whether the person has successfully completed a motorcycle operator training and safety course or is covered by a health insurance plan; 7) a requirement for the Department of Transportation to develop a standard of proof of health insurance coverage for adult motorcycle operators and passengers; and 8) a requirement that all driver education courses or driving safety courses include information on motorcycle awareness, dangers of failure to yield the right-of-way to motorcyclists, and the need to share the road with motorcyclists.   6. It's about time! MOTORCYCLE GROUPS THREATEN LEGAL ACTION OVER N.Y. ROADBLOCKS The National Coalition of Motorcyclists (NCOM) announced that its New York attorney has sent a letter of intent to file a class-action lawsuit against New York State Police and the NYS Department of Motor Vehicles in response to a series of discriminatory roadblocks targeting motorcycles en route to motorcycle-related events. After a roadblock was established on New York's I-84 in October 2007, which singled out motorcyclists on their way to a Marcus Dairy Cycle Sunday in nearby Danbury, Conn., motorcyclists' rights advocates learned that Federal Grant money was to be used to fund police overtime to conduct these so-called 'safety checks' at motorcycle events statewide. Despite talks between DMV and representatives of NCOM, the American Motorcyclist Association, ABATE of New York and other motorcycle rights organizations during the winter, roadblocks were also set up on I-88 and the NYS Thruway targeting motorcyclists traveling to the American Motorcycle Jamboree, or AM-JAM, a 24-year old event held at the Cobleskill Fairgrounds, and again on I-87 stopping riders traveling to Americade in Lake George, America's largest touring motorcycle rally. According to Robert 'Prospector' Boellmer, the New England and New York representative of NCOM, Aid to Injured Motorcyclists (A.I.M.) Attorney Mitchell Proner of New York, NY has given notice to the NY State Police and DMV that a class action suit will be filed in protest of the road checks being conducted on state highways during events that draw thousands of motorcyclists. Warren County Tourism Director Kate Johnson said Americade's 2007 economic impact in the region was estimated to have been $46 million. 'The rally brought about 50,000 motorcyclists to the area last year,' she told the newspaper, adding that attendance was down this year. Boellmer told the Daily Gazette that the stops constitute harassment of cyclists and his group will fight them in court to halt the discriminatory roadblocks. He said the national coalition represents more than a thousand motorcycle organizations across the country. 'ABATE of New York, Inc. expresses its opposition to New York State's burgeoning tactic of conducting highway roadblocks which divert only motorcyclists from the state's roadway for the purpose of conducting 'safety checks', and hereby expresses its support of a class-action initiative by the National Coalition of Motorcyclist against the NYS Police and the NYS Dept. of Motor Vehicles,' said Timothy D. Werder, State President of ABATE of New York in an official press release issued by his organization. With the support of ABATE of New York, the AMA and various other biker rights organizations, NCOM officials plan to pursue legal actions against state agencies involved in what they consider unconstitutional infringements.
  7. Published Wed, May 28, 2008 8:44 AM COLUMBIA, S.C. South Carolina has joined six other states that let motorcyclists, mo-ped drivers and bicyclists run red lights that don't change within a couple minutes of their stopping. Gov. Mark Sanford signed the bill into law Tuesday. It requires motorcyclists, mo-peds and bicycles to stop for two minutes before entering an intersection if a traffic signal has not turned green. Motorcyclists pushed the legislation because they said automatic signal controls using sensor embedded in roads don't always detect their bikes. The American Motorcyclist Association says Arkansas, Idaho, Minnesota, North Carolina, Tennessee and Wisconsin have similar laws.
